What is the National Domestic Workers Bill of Rights?

The National Domestic Workers Bill of Rights is federal legislation that ensures domestic workers are included in common workplace laws while creating new protections and stronger ways to enforce them. The bill, co-sponsored by Senators Kristen Gillibrand and Ben Ray Luján and Representative Pramila Jayapal, will create a national standard that provides the respect, dignity, and recognition that all domestic workers deserve.

This legislation is coming at a critical time for working women. The pandemic not only showed us how essential care is to keep our society and economy going, it highlighted the precarious nature of work that domestic workers, disproportionately composed of Black, Latinx, Asian, and Indigenous women and immigrant women, face everyday. Why do we need a National Domestic Workers Bill of Rights?

Domestic Workers Bills of Rights create real material change for domestic workers. Despite winning Domestic Workers Bills of Rights in 12 states, 2 major cities, and the District of Columbia, federal recognition and comprehensive protection for this workforce is long overdue.

Historically, domestic workers have been excluded from federal workplace protections, leaving them vulnerable to exploitation and mistreatment. This national legislation seeks to rectify this long standing injustice and bring domestic workers under the umbrella of essential labor protections. With a National Domestic Workers Bill of Rights, around 2.2 million domestic workers will be able to establish better pay and working conditions and file complaints in situations of abuse. It is a critical step towards creating fairness and protections in the workplace that would keep all workers safe.

What rights and protections are included in the National Domestic Workers Bill of Rights?

This federal Bill of Rights covers major gaps in protecting domestic workers in the workplace by:

  1. Ending the exclusion of domestic workers from core workplace protections like paid overtime, paid sick days, safety and health coverage under the the Occupational Health and Safety Act, and anti-harrassment and anti-discrimination protections under the Title VII Civil Rights act, including freedom from sexual harassment. The bill will also emphasize protections for live-in domestic workers.
  2. Creating new protections to address the unique challenges of domestic work including written agreements, a new standards board and support for survivors of sexual harassment.
  3. Ensuring that rights aren’t just on paper, but that they can be enforced and implemented through Know-Your-Rights information and education, strengthening protections against retaliation for domestic workers who exercise their rights, creation and funding for an Interagency Task Force on Protecting Domestic Workers’ Workplace Rights.

Timeline of the Bill

The National Domestic Workers Bill of Rights (S.2112 – Domestic Workers Bill of Rights Act) was originally introduced in 2019 by then-Senator Harris and Congresswoman Jayapal. 

In 2021, the bill was reintroduced with the bill text being updated to simplify and clarify the written agreement, fair scheduling, and standards board and notice of rights provisions, clarify how hiring entities must provide schedules and schedule changes, and include lessons learned from the pandemic.

In 2024, the bill has been re-introduced for further support in the Senate.
